Biodiversity and Habitat Management - Draft DCP Chapter 2C

At its Ordinary meeting on 26 March 2026, Ballina Shire Council endorsed the public exhibition of a proposed new biodiversity focused chapter to be included in the Ballina Development Control Plan 2012 (DCP).

Draft Chapter 2C - Biodiversity and Habitat Management supports Council’s Biodiversity Strategy objectives and will better align the development control plan with the New South Wales Biodiversity Conservation Act 2016 (BC Act) and clarify the interaction between the BC Act and the NSW Environmental Planning and Assessment Act 1979. Council’s intent is to provide clear guidance on the biodiversity values that should be retained and address the management of ongoing impacts associated with development.

There is presently a suite of DCP provisions and Council policy that address biodiversity values in relation to development proposals, including DCP Chapter 2 General and Environmental Considerations, Chapter 2A Vegetation Management, and the Biodiversity – Compensatory Habitat and Offsets Policy. Chapter 2C will provide more specific biodiversity related development controls and clearer guidance for applicants in identifying and protecting biodiversity values with the aim of facilitating more efficient and effective development planning and assessment.
