PROPOSAL:
Modification to consent and approved plan set for DA 2016/184 in relation to Stage 8 of the Banyan Hill Estate to enable the following:
Amendments to the area of land to be included in Stage 8
Amendments to Staging to introduce new Stages 8A and 8B
Amendments to the area of land to be included in future development Lot 3-116
Amendments to proposed lot sizes (451m² to 958m²)
Amendments to road layout and lot layout
Amendments to associated infrastructure servicing.
The modification to DA 2016/184 comprises an amendment to “nominated integrated development” and “integrated development” under the EP&A Act 1979 and the Water Management Act 2000 Section 91 and the NSW Rural Fires Act 1997 Section 100B.
The subject development application and associated documents may be viewed by visiting Council’s DAs (Development Applications) Online website da.ballina.nsw.gov.au,and clicking on Applications On Exhibition under the Applications menu.
Persons making a submission may need to disclose political donations/gifts provided to a Councillor or Council employee. Significant penalties apply for non-disclosure. For further information visit the NSW Department of Planning, Housing and Infrastructure website planning.nsw.gov.au
Any person may make a submission in writing to Council. Where a submission is by way of objection the grounds of objection must be specified in the submission. All submissions, including any personal information contained therein, will become publicly available documents and will be made available to the applicant and any other interested members of the public. They may also be included in Council’s business paper. If you do not wish your submission to be publicly available you must provide Council with written reasons for this. Alternatively, you may wish to provide an anonymous submission. However, anonymous submissions may be given less (or no) weight in the overall consideration of the proposal.
This development application may be reported to Council for determination at one of its Council Meetings. In accordance with Section 106 of the Environmental Planning and Assessment Regulation 2021, if the modification to DA 2016/184 is approved, there is no right of appeal to the Court by an objector.
