LEP General Amendments - Planning Proposal 2026-1684

Ballina Council resolved at its July 23 meeting to initiate a series of minor amendments to its Local Environmental Plan (LEP). The General Amendments Planning Proposal 2026 (PP-2026-1684) seeks to make the following amendments:

1. Allow additional flexibility in the realignment of property boundaries in areas with rural and conservation zones.

2. Adoption of a new public bushland clause that sets out assessment criteria for development assessment and the circumstances whereby activities do not require consent.

3. Change of zoning for the Ballina waste facility from RU2 (Rural Landscape) to SP2 (Infrastructure) ‘waste or resource management facility’ to better reflect the current and long term use of the site.

Council is now seeking feedback on the proposal.

Any person may make a submission in writing to Council. Where a submission is by way of objection the grounds of objection must be specified in the submission. All submissions, including any personal information contained therein, will become publicly available documents and will be made available to the applicant and any other interested members of the public. They may also be included in Council’s business paper. If you do not wish your submission to be publicly available you must provide Council with written reasons for this. Alternatively, you may wish to provide an anonymous submission. However, anonymous submissions may be given less (or no) weight in the overall consideration of the proposal. The planning proposal and a report of submissions received will be reported back to Council prior to finalisation of any LEP amendments.
