A planning proposal (PP) and an associated draft development control plan (DCP) have been prepared over rural zoned land located to the west of Ballina Heights Drive, Cumbalum, (west of the water reservoir site) and extending to Albert Sheather Lane.
The PP seeks to apply residential (R2 & R3), recreation (RE1) and conservation (C3) zones to land currently zoned rural (RU1 and RU2) under the provisions of Ballina Local Environmental Plan 2012 (LEP). The area subject to zone changes is outlined in red on the diagrams below.

The Planning Proposal provides for amendments to the LEP Land Zoning, Lot Size, Strategic Urban Growth Area and Urban Release Area Maps.
A concept allotment layout plan submitted with the PP shows 91 residential lots within the rezoning area. Minimum proposed lot sizes vary from 1,200m2 in the R2 zone, to 800m2 and 450m2 in the R3 zone.
The Planning Proposal also proposes a change to the minimum lot size applicable to the rural zoned residue land not proposed to be rezoned for urban purposes (40ha to 20ha), and also a 2ha minimum lot size for the proposed C3 zoned area.
The draft development control plan provides for amendments to Ballina DCP 2012 Chapter 3 Urban Subdivision (section 5.6 and Appendix D).
The Planning Proposal and DCP amendments have been prepared in accordance with the resolution of the Council at its Ordinary meeting on 24 April 2025, as amended by the requirements of the Department of Planning, Housing and Infrastructure’s Gateway determination dated 19 December 2025.
A report on any submissions received will be considered by the Council prior to finalisation of any LEP and DCP amendments.
Council is not the Local Plan Making Authority for this planning proposal. This role has been retained by the Department of Planning, Housing and Infrastructure.
