Aureus Village Rezoning Planning Proposal 24/004
In accordance with section 3.34(2)(c) and clause 4 of Schedule 1 of the Environmental Planning and Assessment Act 1979, notice is given that the following Planning Proposal has been placed on public exhibition for community feedback.
Rezoning Part Lot 346 DP 1271483, 21 Aureus Boulevard, Skennars Head
The Planning Proposal will amend the Ballina Local Environmental Plan 2012 (LEP) by rezoning approximately 6,650m² (approximately half of the subject land) from E1 Local Centre to R3 Medium Density Residential. The Planning Proposal also amends the associated LEP maps for Floor Space Ratio, Minimum Lot Size, and Height of Buildings. The purpose of the rezoning is to enable the development of medium density housing within the Aureus residential estate, consistent with the strategic planning framework for Skennars Head.
The Planning Proposal has been prepared in accordance with the Gateway Determination issued by the NSW Department of Planning, Housing and Infrastructure under section 3.34(1) of the Environmental Planning and Assessment Act 1979. Council is authorised to exercise the functions of the local plan-making authority which means Council is responsible for preparing and making the Local Environmental Plan.
The Planning Proposal is supported by a draft Planning Agreement that provides that any new housing on the R3 Land can only proceed once an occupation certificate has been obtained for at least 600m² of gross commercial floor space on the E1 Land. It also provides that residential uses are to be prohibited in the E1 zone except for shop-top housing. This will ensure housing growth is matched with a functional neighbourhood centre.
The Planning Proposal, draft Planning Agreement, and supporting documents are available for public exhibition from Wednesday 20 August 2025.
Submissions close: Friday 19 September 2025.

Any person may make a submission in writing to Council. Where a submission is by way of objection, the grounds of objection must be clearly stated.
All submissions, including personal information contained therein, will be made publicly available to the applicant and interested members of the public, and may be included in Council’s business papers. If you do not wish your submission to be made publicly available, you must provide written reasons. Anonymous submissions may be given less (or no) weight in the consideration of the proposal.
