Ballina Heights South Precinct Structure Plan - DCP Chapter 3 Amendment

Ballina Shire Council resolved at its August 2026 Ordinary meeting to put on public exhibition a draft Structure Plan and associated amendments to Chapter 3 of the Ballina Development Control Plan (DCP) relating to future residential development of the southern precinct of the Ballina Heights estate. The southern precinct is the area south of Deadman’s Creek Road and east of Summerhill Crescent and zoned R3 Medium Density Residential as shown on the figure below.

The draft Structure Plan sets out the indicative locations for future roads, cycle and pedestrian paths, a public reserve and the residential lot areas. Development controls are also proposed for the precinct relating to earthworks, roads and street trees, hydrology and stormwater and a requirement for a feral animal fence. Future subdivision development applications will need to address these southern precinct specific controls in addition to all other applicable planning controls.

Council is now seeking feedback on the proposed amendments to section 5.4 of Chapter 3 of the Development Control Plan.

Making a Submission

Any person may make a submission in writing to Council. Where a submission is by way of objection the grounds of objection must be specified in the submission. All submissions, including any personal information contained therein, will become publicly available documents and will be made available to the applicant and any other interested members of the public. They may also be included in Council’s business paper. If you do not wish your submission to be publicly available you must provide Council with written reasons for this. Alternatively, you may wish to provide an anonymous submission. However, anonymous submissions may be given less (or no) weight in the overall consideration of the proposal.
