Consultation concluded 1 October 2024.
At its Ordinary meeting on 22 August 2024, Council resolved to place on public exhibition draft amendments to Chapter 4 of the Ballina Shire Development Control Plan 2012 (BSDCP), in accordance with the Environmental Planning and Assessment Act 1979 and the associated Regulation, subject to the landscape area for allotments greater than 900 m² being a minimum of 30%.
Chapter 4 of the BSDCP identifies Council's requirements relating to development applications for all forms of residential and tourist accommodation development.
The draft amendments follow a detailed review of Chapter 4 undertaken to ensure the controls remain contemporary and ‘fit for purpose’ and provide an appropriate balance between ensuring quality design outcomes and facilitating quick and efficient assessment of applications for residential development. The review concentrated on controls applying to dwelling houses, secondary dwellings, and dual occupancies as these housing types form a significant proportion of development applications to Council. Council’s aim is to simplify the provisions for smaller scale residential development while providing for high quality urban design and built form outcomes.
The report to Council outlines the reasons for the proposed amendments with key changes including:
Setbacks, including building height plane
Solar access and climate appropriate building design
