In accordance with Schedule 1 of the Environmental Planning and Assessment Act 1979, Notice is hereby given that the following nominated integrated development application has been lodged for Council’s assessment and determination.

PROPERTY:

  • Lot 616 DP 1280098, 52 Albert Sheather Lane, CUMBALUM
  • Lot 528 DP 1281430, Ballina Heights Drive, CUMBALUM
  • Lot 2 DP 1263184, Albert Sheather Lane, CUMBALUM
  • Lot 363 DP 1273203, 658 Tamarind Drive, CUMBALUM

PROPOSAL: Bulk earthworks (cut and fill), vegetation removal and associated works as relating to the amended layouts for Stage 8 of DA 2016/184, including the erection of retaining walls, road formation, temporary sediment and erosions control basins, silt fencing, temporary drainage, vehicular shakedown points and other related site works.


DA 2023/529 comprises “nominated integrated development” under Section 4.46 of the EP&A Act 1979, as it requires an approval from NSW Department of Planning and Environment - Water under the Water Management Act 2000, Section 91.

The subject development application and associated documents may be viewed by visiting Council’s DAs (Development Applications) Online website da.ballina.nsw.gov.au, and clicking on Applications On Exhibition under the Applications menu.

Persons making a submission may need to disclose political donations/gifts provided to a Councillor or Council employee. Significant penalties apply for non-disclosure. For further information visit the NSW Department of Planning, Housing and Infrastructure website planning.nsw.gov.au

Any person may make a submission in writing to Council. Where a submission is by way of objection the grounds of objection must be specified in the submission. All submissions, including any personal information contained therein, will become publicly available documents and will be made available to the applicant and any other interested members of the public. They may also be included in Council’s business paper. If you do not wish your submission to be publicly available you must provide Council with written reasons for this. Alternatively, you may wish to provide an anonymous submission. However, anonymous submissions may be given less (or no) weight in the overall consideration of the proposal.

This development application may be reported to Council for determination at one of its Council Meetings.
