Planning Proposal 2024-2438 E1 Local Centre Zone Relocation & Height of Building Increase -

47 Dufficys Lane and Ross Lane, Kinvara - Cumbalum Urban Release Area Precinct B (CURA B)

In accordance with the Environmental Planning and Assessment Act 1979, notice is given that the following Planning Proposal is on public exhibition for community feedback.

The Planning Proposal seeks to amend the Ballina Local Environmental Plan 2012 (LEP) in relation to part of Lot 60 DP 1136918 and part of Lot 11 DP 1127111 within CURA B to:

  • relocate the E1 Local Centre zone to a more central location within CURA B by:
  1. rezoning approximately 2.38 hectares of R3 Medium Density Residential land to E1 Local Centre, and
  2. rezoning approximately 2.97 hectares of the existing E1 Local Centre zoned land to R3 Medium Density Residential; and
  • increase the maximum building height applying to the relocated E1 Local Centre zoned land from 8.5 metres to 11 metres; and
  • amend the applicable minimum lot size mapping to reflect the proposed zoning changes.

The proposed relocation of the E1 Local Centre is intended to provide a more central, accessible and relatively level location for the future village centre, improving its relationship with surrounding residential areas and reducing the extent of earthworks required. The proposed 11 metre maximum building height is intended to support a mix of commercial uses and shop-top housing within the future local centre.

The Planning Proposal also facilitates consequential amendments to the Urban Release Area Map under State Environmental Planning Policy (Planning Systems) 2021 and the Greenfield Housing Code Area Map under State Environmental Planning Policy (Exempt and Complying Development Codes) 2008 to align these maps with the proposed zoning changes.

The NSW Department of Planning, Housing and Infrastructure issued a Gateway Determination for the Planning Proposal on 28 May 2026 in accordance with of the Environmental Planning and Assessment Act 1979.

The Planning Proposal is supported by a draft Planning Agreement between Ballina Shire Council and Lennox Head Development Corporation Pty Ltd. The draft Planning Agreement provides for a minimum amount of retail floor space to be delivered alongside housing to ensure early establishment of a centre that meets the local shopping needs of residents and is economically viable. It also provides that residential development, other than shop top housing, is prohibited in the E1 Local Centre zone.

The Planning Proposal, draft Planning Agreement, and supporting documents are available for public exhibition from 4 November 2026 to 2 December 2026.
